LEGAL STANDARDS

Conditions & List of Documents to Prepare

Each type of temporary residence card has its own requirements for documents proving authority and residence status.

CODE: LĐ2Maximum 02 years

Labor Temporary Residence Card

Applicable to foreign workers working at enterprises who already have a valid Work Permit.

Customers need to provide:

  • Original passport (valid for at least 30 days longer than the expected card term).
  • Original Work Permit or notarized copy.
  • 02 ID photos 2×3 cm with white background, no glasses.
  • Confirmation of online temporary residence declaration from the ward/commune police.

Legalkey performs:

  • Drafting forms NA6, NA8, NA16 according to the legal entity dossier of the sponsoring company.
  • Representing the client in submitting the dossier at the Immigration Department / Division and hand-delivering the results.

Investment Temporary Residence Card

Applicable to foreign investors named on the Investment Certificate or the Business Registration Certificate.

Customers need to provide:

  • Original passport valid for more than 03 to 05 years.
  • Notarized copies of the Investment Certificate (IRC) and Business Registration (ERC).
  • Documents proving full contribution of charter capital of VND 03 billion or more (DICA bank statement).
  • 02 ID photos 2×3 cm and valid temporary residence declaration confirmation.

Family Visit Temporary Residence Card

Applicable to relatives (spouse, children under 18) of foreign experts or of people married to Vietnamese citizens.

Customers need to provide:

  • Original passports of the card applicant and the sponsor.
  • Marriage registration certificate or the child’s Birth certificate.
  • Original Temporary residence card / Work Permit of the sponsor.
  • Chip-based Citizen ID card (in case the sponsor is a Vietnamese citizen).

5-Year Visa Exemption Certificate

Pursuant to Decree 82/2015/ND-CP: Applicable to Vietnamese people residing abroad (overseas Vietnamese) and foreigners who are spouses or children of Vietnamese citizens or of overseas Vietnamese.

Customers need to provide:

  • Foreign passport valid for at least 01 year (the Visa Exemption Certificate term is at least 06 months shorter than the passport validity).

  • Documents proving Vietnamese origin (Birth certificate, old Household registration book, old ID card…) or Marriage certificate/Birth certificate proving the relationship.

  • Copy of the chip-based Citizen ID card (with VNeID identification) of the sponsoring relative in Vietnam.

  • 02 ID photos 4×6 cm with white background, looking straight ahead, no glasses.

Legalkey performs:

  • Verifying the legality of Vietnamese-origin/relative documents, completing Declaration Form NA9.

  • Representing the client in submission at the Immigration Department, receiving the result as a sticker affixed to the passport after 05 working days (entry with a stay of 180 days/entry, further extension in Vietnam under Article 10, Article 11 of Decree 82).

4-Step Process for Receipt & Delivery

Transparency on timelines and handling responsibilities between Legalkey and the customer:

Dossier Examination

Customers send photos of their passport, visa and supporting documents (Work Permit, Investment License, Marriage certificate) via Zalo. Specialists check the card issuance conditions free of charge.

Drafting Forms NA6, NA8

Completing the forms in line with Circular 22/2023/TT-BCA, certified translation of foreign documents and assigning staff to bring the dossier to the enterprise for signing and stamping.

Representative Submission to Authorities

Legalkey specialists submit the dossier on your behalf at the Immigration Department or the Immigration Division of HCMC / Binh Duong Police and receive the official appointment slip.

Receiving the Original Card & Delivery

Receiving the original Temporary Residence Card after 7–10 working days, checking the accuracy of the information and delivering it to the customer's door together with the USD state fee receipt.

Short-Term Visa Vs Temporary Residence Card

Continuity of residence Must continually extend or exit the country (visa run) every 30 – 90 days. Continuous legal residence for 02 to 05 years, no worries about interruption.
Entry and exit rights Must apply for a new visa or check the remaining days each time you exit the country. Free entry and exit with unlimited number of times, visa-exempt together with the passport.
Banking transactions & Housing Limited bank account terms, difficult to be named on long-term lease contracts. Eligible to open long-term bank accounts and purchase apartments under the Law on Housing.
Family sponsorship No right to sponsor relatives to reside together. Entitled to sponsor spouse and children under 18 to apply for a TT-category Temporary residence card.
